DWIs
Most of Brad Polk’s career with the Wake County District Attorney’s Office was spent prosecuting Driving While Impaired (DWI) offenses. He has personally tried over 500 DWI cases in District Court and has even argued cases that were appealed to Superior Court. In addition to the knowledge that can only come from the experience of litigating so many cases, Brad has also received extensive training from several state agencies responsible for the detection of impaired drivers. In 2009, Brad attended a regional DWI course for law enforcement and prosecutors sponsored by the N.C. Governor’s Highway Safety Program. As part of this training, Brad worked side-by-side with law enforcement personnel who further educated him on the cues used for DWI detection. He was trained using the same standardized field sobriety tests law enforcement agencies use during their investigations.
Brad has also worked with the State of North Carolina’s Forensic Tests for Alcohol Branch, a division of the Department of Health and Human Services that developed the instrumentation used to measure a suspect’s breath alcohol level. Currently, North Carolina uses the Intox EC/IR II to measure breath alcohol. Brad received individual training on the absorption, distribution, and elimination of alcohol in the body as well the scientific principles behind the EC/IR II.
As a former prosecutor, Brad’s courtroom experience uniquely qualifies him to effectively represent his clients on all matters concerning a DWI charge.
